Why it matters

The right valuation saves lakhs — the wrong one costs you

Two big levers turn on a valuation. In India, for property acquired before 1 April 2001, you can use its fair market value on that date as your cost of acquisition — cutting your capital gain. In the US, if you're a US person who inherited Indian property, your cost basis is the fair market value at the date of death — a valuation locks in a step-up that can save large US capital-gains tax later, and you need that figure for Form 3520.

A registered valuer's report is the legally-valid evidence for both — with methodology, comparables and the relevant stamp-duty data, so it holds up under scrutiny. Inherited Indian property as a US person? Your US cost basis is the FMV at the date of death — a valuation locks in a step-up that can save large US capital-gains tax when you sell, and Form 3520 needs that FMV for inheritances over $100,000. Who carries out the valuation?

What is the FMV as on 1 April 2001, and why does it matter?

For property acquired before 1 April 2001, you can use its fair market value on that date as your cost of acquisition instead of the (often tiny) original cost — which reduces your taxable gain. The value is capped at the 2001 stamp-duty value, and a registered valuer's report substantiates it.

I'm a US citizen who inherited property in India — do I need a valuation?

Almost certainly. Your US cost basis is the fair market value at the date of death, so a valuation locks in a step-up that lowers your future US capital-gains tax — and you'll need that FMV to report the inheritance on Form 3520 (required over $100,000). We provide the India-side report your US preparer needs.

Is the report legally valid?

Yes — a registered valuer's report carries evidentiary weight with the Income-tax Department and is the standard support for capital-gains, probate and cross-border filings. It includes methodology, comparables and the relevant stamp-duty / circle-rate data.
